Article 1. Definitions

In these general terms and conditions, the following terms are defined as follows:

Entrepreneur: Artizta.audio, located at Ariensplein 1, the Netherlands.

Customer: The natural or legal person entering into an agreement with Artizta.audio.

Product: The products offered by Artizta.audio, such as the Ferro Bluetooth speaker and related accessories.

Pre-sale: The option to pre-order a product, with delivery taking place at a later date.

General Terms and Conditions: These general terms and conditions.

Article 2. Applicability

1.These general terms and conditions apply to every offer made by Artizta.audio and every agreement concluded between Artizta.audio and the customer.

2.Before the remote agreement is concluded, the text of these general terms and conditions will be made available to the customer.

3.By placing an order via the Artizta.audio website, the customer agrees to these general terms and conditions.

Article 3. Offer and Pre-sale

1.Artizta.audio’s pre-sale offer includes a full and accurate description of the products and the associated prices. The prices include VAT.

2.During the pre-sale, customers can purchase the Ferro at a reduced price of €399, instead of the later retail price of €499.

3.The expected delivery date for the Ferro is July 2025, but the customer accepts that this date may shift. If delivery is delayed, no compensation will be provided to the customer.

4.The customer will receive regular updates on the progress of production via email.

5. Product changes: Artizta.audio reserves the right to make minor changes to the product without prior notice, provided that such changes do not adversely affect the functionality.

Article 4. Payment

1.Payments can be made via the Mollie payment service, supporting the following methods: iDEAL, MasterCard, Klarna, PayPal, Apple Pay, IDEAL-in3, SEPA, Trustly.

2.After placing an order, the customer will receive an order confirmation by email with all the details.

3.In the case of upfront payment (100%), the customer will receive a 10% discount on the total amount.

4. Payment Default: If the remaining balance is not paid on time, Artizta.audio reserves the right to cancel the order and retain the down payment. After submitting the payment request, the customer must pay within 14 days. If payment is still not received after this period, Artizta.audio reserves the right to cancel the order definitively.

Article 5. Right of Withdrawal and Cancellation

1.The customer has the right to cancel an order and request a refund, both during the pre-sale and before delivery, without giving a reason.

2.If the customer cancels their order before delivery, the full amount, including any down payment, will be refunded within 14 days.

3.After delivery, the customer has 14 days to assess the Ferro and decide whether to keep the product.

4.During these 14 days, the customer may open the packaging and test the product, provided this is done carefully. If it is found that the product is damaged or has been used more than necessary for assessment, Artizta.audio may charge a compensation fee.

5.Returns outside the withdrawal period will only be accepted if the product is defective within the warranty period.

Article 6. Delivery & Shipping

1.The expected delivery date for the Ferro is July 2025. The customer accepts that this date may be delayed. No compensation will be offered for delayed deliveries.

2.The customer will receive a shipping confirmation by email once the product is ready for dispatch.

3.Artizta.audio is not responsible for any delays caused by third parties, such as courier services.

4. Free shipping within Europe and the United States: All orders within Europe and the US are shipped at no extra cost.

Shipping costs for other countries: For orders outside of Europe and the United States, we apply a flat-rate fee of €55 per order, including customs fees. This ensures no unexpected costs for the customer upon delivery.

5. Force Majeure: Artizta.audio is not liable for any delay or failure to fulfill its obligations due to force majeure, such as natural disasters, government measures, war, strikes, pandemics, or other circumstances beyond its control.

Article 7. Warranty and Liability

1.The Ferro comes with a standard 2-year warranty. The customer can opt to extend the warranty by an additional 2 years.

2.Water damage and damage caused by drops are not covered by the warranty.

3.If the product becomes defective within the warranty period, the customer can return the product. The customer is responsible for the shipping costs.

4.If the defect is covered under warranty, Artizta.audio will send a new Ferro and reimburse the shipping costs.

5. Limitation of Liability: Artizta.audio is not liable for any indirect, incidental, special, or consequential damages, such as loss of income, lost profits, or loss of data.

6.Artizta.audio is not liable for damage resulting from improper use of the Ferro.

Article 8. Customer Service and Availability

1.For questions about the product or delivery, the customer can contact Artizta.audio via email at [email protected] or WhatsApp at +31 6 16355360.

2.Artizta.audio will strive to respond to inquiries within 48 hours.

Article 9. Complaints Procedure

1.If the customer has a complaint about the product or service, the complaint can be submitted via email to [email protected].

2.Artizta.audio will respond to the complaint in writing within 14 days.

3.If the complaint is not resolved to the customer’s satisfaction, the customer can contact the Disputes Committee (part of Thuiswinkel Waarborg).

4.For consumers within the EU, it is also possible to submit complaints via the European ODR platform (Online Dispute Resolution).

Article 10. Applicable Law

1.All agreements between Artizta.audio and the customer are governed by Dutch law.

2.Any disputes will be submitted to the competent court in the Netherlands.

Article 11. Privacy and Data Protection

1.Artizta.audio handles customer data with care and in accordance with applicable privacy legislation. Your data will only be used for processing orders and providing updates about your order.

2.Artizta.audio will never share customer data with third parties without the customer’s explicit consent unless required by law.

Final Provisions

Artizta.audio reserves the right to amend these general terms and conditions at any time. The customer will be informed of any changes in a timely manner.
